how can i solve Verizon htc ozone troubles

Recently, I have been trapped in this trouble that I wonder to exchange my cellphone. Insteading of it with new Verizon htc ozone, however, my contract with VerioznWireless is up in may 2010. Anyone who can tell me that I have to call my contract off so that I can get a data plan to have the htc ozone phone.

Any advices will be ok! I would appreciate it so much!
